DWI Process in North Carolina
After a person is stopped by the police, if they have had anything to drink, they have the opportunity to submit to a Breathalyzer test. There are two main outcomes that can then lead to a drunk driving arrest:
- If you refuse to blow into the Breathalyzer, your license will be revoked automatically for one year and you can still be charged with a DWI.
- If you do submit to the Breathalyzer test and your blood alcohol content is over .08, you will be arrested and charged with DWI.
Once you are arrested, your case is set for trial. It is my job to talk to the investigating officer, and counsel you as to whether you should go to trial or work out an agreement.
There are several ways to fight a drunk driving charge. I will examine the following:
- Whether the initial stop was constitutional
- Whether the officer had reasonable cause to stop you
- Whether the Breathalyzer had an accurate result
- Whether you were actually impaired or not.
In some cases, the results of the breath test may be thrown out for improper calibration or improper procedures.
I also understand that certain drivers have more to lose than others. Truckers and other professional drivers with a commercial driver's license or CDL only have to blow a .04 on a breath test in order to be charged with drunk driving in North Carolina.
